ferkas.market ("FERKA$", "the marketplace", "we", "us") is an online marketplace operated by FERKAS GLOBAL LTD that enables independent third-party sellers and brands ("Sellers") to list products for sale to buyers worldwide ("Buyers").

Unless a listing clearly identifies FERKAS GLOBAL LTD as the seller of record, the contract of sale for each order is formed directly between the Buyer and the Seller of that product. FERKAS GLOBAL LTD acts as an intermediary providing the platform, checkout, payment collection, escrow of funds, buyer-protection tooling, and dispute resolution.

By using the marketplace you agree to these Terms and to all incorporated policies (Privacy, Cookies, Seller Agreement, Buyer Protection, Seller Payout Protection, Shipping, Returns & Refunds, Cancellation, Marketplace Rules, Marketplace Protection Rules, Prohibited Products, IP & Counterfeit, Dispute Resolution, and Platform Rights).

You must be at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter binding contracts.

You are responsible for the accuracy of your account details and for all activity under your account. Notify us immediately at support@ferkasglobal.store of any unauthorised access.

One person or business may hold only one active account unless we authorise otherwise in writing. Creation of duplicate, misleading, or evasive accounts is a serious breach of these Terms.

All prices are shown in the currency indicated at checkout and may exclude taxes, duties, and shipping fees, which are calculated before you confirm your order.

Your order is an offer to buy. A contract is formed only when the Seller (or FERKAS GLOBAL LTD, where it is the seller) confirms dispatch of the item(s).

We reserve the right to refuse, cancel, or limit any order, including where a listing contains a manifest pricing or description error, where fraud is suspected, or where the delivery address is on a sanctions or restricted list.

Payments are processed through regulated payment providers. By submitting payment details you authorise the charge for the total order value including taxes, shipping, and applicable fees.

Funds collected from Buyers are held by FERKAS GLOBAL LTD (or its licensed payment partners) in a segregated escrow arrangement and are released to Sellers in accordance with the Seller Payout Protection Policy.

Delivery, returns, refunds, and cancellations are governed by the Shipping Policy, Return & Refund Policy, and Cancellation Policy, each of which forms part of these Terms.

Buyers and Sellers must comply with the Marketplace Rules, Buyer Protection Policy, Seller Agreement, and Marketplace Protection Rules. Serious or repeated breach may result in account suspension, forfeiture of pending payouts, and referral to law enforcement.

You agree not to misuse the marketplace, including by attempting to defraud Sellers or Buyers, scraping listings at scale, uploading malicious content, circumventing fees, transacting off-platform, or infringing anyone's rights.

The ferkas.market brand, site design, source code, database rights, and platform software are owned by FERKAS GLOBAL LTD or its licensors. Product images, descriptions, and third-party brand names remain the property of their respective owners.

Nothing in these Terms limits liability that cannot be limited by law (including for death or personal injury caused by negligence, or for fraud).

Subject to the above, and to the maximum extent permitted by law, FERKAS GLOBAL LTD is not liable for the acts or omissions of independent Sellers beyond its role as marketplace operator, and its aggregate liability to any user for any claim relating to a single order is limited to the value of that order.

Where FERKAS GLOBAL LTD is directly the Seller of an item, statutory consumer rights apply in full.

We may modify these Terms and any policy at any time. Material changes will be notified by email or in-account notice at least 15 days before they take effect (except changes required urgently by law or to address a security/fraud risk, which may take effect immediately).

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, save that Consumers resident in the EU or elsewhere retain the benefit of any mandatory local consumer-protection laws and the right to bring proceedings in their local courts.
